Wait times are the length of time you must wait before petitioning the court to have a record sealed. The wait time begins the later of the conviction date or the date of release from supervision (probation, parole, incarceration). For information on wait times please see below.
A record may not be sealed if you owe restitution. You can request that a record be sealed if you still owe fines, court costs, late fee's, or other fee's.
Certain records are not eligible for sealing. If you are uncertain as to whether a conviction can be sealed, please see the Ineligible Offenses page for more information.
Offenses committed by victims of human trafficking
Petty offenses and drug related petty offenses
Class 2 misdemeanors, class 3 misdemeanors, any drug misdemeanor, and level 4 drug felonies under C.R.S. § 18-18-403.5(2.5)
Class 4 felonies, class 5 felonies, class 6 felonies, level 3 drug felonies, level 4 drug felonies (except under 18-18-403.5(2.5), and class 1 misdemeanors.
All other eligible offenses
If your highest or worst offense is/are petty offenses and drug related petty offenses
If your highest or worst offenses is/are misdemeanors, drug misdemeanors, and level 4 drug felonies.
If your highest or worst offenses is/are felonies and drug felonies
Repeat SEPERATE convictions of certain eligible(sealable) crimes may render the records unable to be sealed. For more information on exceptions see section 3 here:
If these are your highest(worst) sealable offense(s) and there are more than 5 convictions in SEPERATE CASES the record(s) cannot be sealed.
If these are your highest(worst) sealable offense(s) and there are more than 4 prior convictions in SEPERATE CASES the record(s) cannot be sealed.
If these are your highest(worst) sealable offense(s) and there are more than 3 prior convictions in SEPERATE CASES the record cannot be sealed.
If these are your highest(worst) sealable offense(s) and there are more than 3 prior convictions in SEPERATE CASES the record cannot be sealed.
